    Not sure if you need to be entertainment lawyers specifically.

    Also ppl who may be able to answer....


    How does this thing work with music.
    So many companies use artists music for ads these days
    eg steady bouncing in jeeps on the NY streets :
    Thats new Qtip for some jeep

    I mean those Captain Morgan ads are on all the time with the snippet of Destra's music.

    Then there is the who let the dogs out song....

    What are the payment options for opportunities like these?

    Does she get paid a percentage everytime the ad airs?

    or would she be offered a lump sum to use it in the campaign regardless of how successful it becomes?

    Or is she just happy her music gets exposure and says thank you?

    Break it down for me please

    Not a lawyer...but I play one on Imix.


    The 'owner' of the song (usually the songwriter and the label) gets a pay per play if it's radio.

    In the case of a commercial or a sample used in another song, tehn that's negotiable on a case by case basis...they could negotiate a lump sum payment, or a percentage of all revenue generated by the Ad or (new) song.

    *the artist (as well as others involved...depending) gets paid everytime the commercial airs.

    the artist gets no money
    only if the artist sold the rights of the song to someone or the company using the material

    Thank you so mac if its a Beatles situation like when MJ owned the masters of some of their catalogue he not their families would make profits from the songs.

    Bake an Shark so Destra would have had to write or co-write the song to get something???

    Also artists get about 10c for every album sold (after label, lawyers, repaymentof advances and videos)...if you know what is a typical pay per play price?

    Yup. MJ bought the Beatles library, not necessarily the masters, so he owns the copyrights to their songs.

    Also artists get about 10c for every album sold (after label, lawyers, repaymentof advances and videos)...if you know what is a typical pay per play price?

    I don't know anything about the industry in that kinda depth to say what the pay per play price might be...sorry

    the whole question is ownership... who owns it and controls it.
    If I wrote the song for destra and sold it to her relinquishing all my rights then i gets nothing
