Last March, Stallworth, while driving drunk, struck and killed a pedestrian near Miami Beach, the morning after he had received a $4.5 million roster bonus from the Browns. He pleaded guilty to D.U.I. manslaughter, a felony, and spent 24 days in jail, a light sentence given, in part, because of claims of contributory negligence by the pedestrian, who was not in a crosswalk when he was struck.

    guess Stallworth had "better" management.

very unfair. i believe the penalty for manslaughter or killing someone while driving should be much more steep

dont be sorry.........look at the bigger picture.......the law is dotish........Stallworth was DWI........as far as I know a pedestrian ALWAYS have the right of way..........poor fella wasnt in d crosswalk when he get killed so d Manslaughter sentence is weak.........the other argument is dat Plaxico brought harm only to himself.........there is an imbalance

That is completely untrue within the law. That's nothing more than an urban legend. Check your DMV books; I just took an online DMV test yesterday so it's still fresh in my mind. The pedestrian always has the right of way given they are crossing in an intersection or at a corner. They don't have free reign of the entire road.

There is no imbalance. The guy was jaywalking in the dark of the night nowhere near the corner on a busy local highway. There is nothing to suggest that alcohol even played a part in the accident. i.e. the accident would've likely happened if the driver was sober.

If you're driving down a highway obeying the speed limit, and a pedestrian jumps in front of you and you have no time to stop and avoid him.......do you think you should be up for vehicular manslaughter??

Certainly DWI resulting in manslaughter has more of an impact than illegal possession of a firearm. That said, comparing two different cases in two different jurisdictions is much like comparing apples and oranges.

definitely overkill in the case of Plax. They wanted to make an example out of him. Given the fact that no one was hurt and that he ended up hurting just himself, i think his punishment was excessive. And might i add that many are jealous of young black athletes who did not go to ivy league schools but making wayyy more money than many who did.

Not to mention Stallworth's drivers license is suspended for LIFE, 2 years of house arrest, 8 years of probation, random urine tests for the next 10 years and 1000 hours of community service.
